Agreeing to these terms

These terms cover your use of this website and any work you hire Vertex Sunnyvale Concrete to do. By using the site, calling us or booking a job, you agree to them. If you don't agree, please don't use the site.

When we take on a job, we put the details in a written estimate or agreement for that job. If that document says something different from this page, the document for your job controls, because it was written for your property.

What we do and what this site is for

We're a concrete contractor in Sunnyvale, CA. We build driveways, patios, sidewalks, steps, garage floors, pool decks, retaining walls, footings and foundations. We also do stamped and decorative concrete, foundation raising and concrete cutting. You can find every service from our home page and read about who we are on our About page.

What you read on this site is general information to help you understand the work. It isn't a promise about your job, because no two sites are the same until we've seen yours. We try to keep the site accurate and current, but we provide it as is and don't guarantee it's complete.

Estimates and pricing

Our estimates are free, done in person and come with no obligation. We price a job only after seeing it, because the size, the ground under the slab, how much old concrete has to come out, access for the truck and the finish you choose all change the cost.

An estimate is our price for the work it describes, based on what we could see. If something turns up after the old concrete comes out that nobody could have seen beforehand, like soft ground or buried debris, we'll show you and agree on any change with you in writing before we keep going.

Prices hold for the period written on the estimate. After that we may need to update them, since material costs change.

Scheduling, weather and cancellation

We set a start date with you once you accept the estimate. Concrete depends on the weather, so we may move a pour if rain, heat or other conditions would weaken the finished slab, and we'll let you know as soon as we know.

Some jobs need a permit from your city. Your written agreement will say who is responsible for getting it, and the start date may depend on when it's issued.

If you need to cancel or reschedule, call us at (669) 348-0343 as early as you can. If we've already ordered materials, set forms or booked a concrete delivery for your job, we may charge for those costs as your agreement describes. Any cancellation rights you have under California law still apply.

What we ask of you

Please give our crew clear access to the work area on the scheduled days, and keep cars, pets and kids out of it while we work. Tell us about anything buried that you know of, like sprinkler lines, drain pipes or old footings, so we can work around it.

Once the pour is done, stay off the new concrete for as long as we tell you. Curing is the wait while the concrete gains its strength, and walking or driving on it too soon is one of the most common ways a new slab gets damaged.

Payment

Your agreement lists the payment schedule, including any deposit and when the balance is due. Any deposit we ask for will stay within what California law allows.

If a payment is overdue, we may charge the late fees written in your agreement and pause work until the account is current.

Our guarantee and what it doesn't cover

We're licensed and insured, and our work is backed by our satisfaction guarantee. If you're not happy with something on your job, tell us. Any written warranty for your job is spelled out in your agreement.

Concrete can crack even when it's done right. We cut control joints, the grooves that give the slab a planned place to crack, so most cracks end up in those lines instead of across the middle. Hairline cracks, slight color differences between pours and normal surface wear are part of how concrete behaves and aren't defects.

Our guarantee doesn't cover damage we didn't cause, such as using the slab before it has cured, loads heavier than it was built for, deicing salts, tree roots, drainage changes made after our work, or ground movement.

Apart from what's in your written agreement and any warranty the law requires, we make no other promises about our work or this website, express or implied.

Limits on our liability

As far as California law allows, we aren't responsible for indirect or consequential losses tied to our work or this website, like lost income or lost use of your property. Our total responsibility for any claim about a job is limited to the amount you paid us for that job.

Nothing in these terms limits responsibility the law doesn't let us limit, such as for injuries we cause or our own gross negligence.

If we disagree

If something goes wrong, please call us or write to us through our contact page first. Most problems get settled with a conversation, and we'd rather fix something than argue about it.

If we can't settle it that way, either of us may take the matter to small claims court or to the state courts in Santa Clara County, California.

Which law applies

These terms and any work we do for you are governed by the laws of the State of California.

Changes to these terms

We may update these terms from time to time and post the new version on this page. The terms that apply to your job are the ones in place when you sign your agreement, and later changes won't alter an agreement we've already signed with you.
